Terms of Service

Last updated: February 2025

These Terms of Service ("Terms") govern your use of SystemsUnity's website and any web design, development, retainer, or monthly services ("Services") we provide. By engaging our Services or using our site, you agree to these Terms.

Services

SystemsUnity offers website design and development, growth systems, and related services as described on our website (e.g., Launch Site, Growth Site, Revenue System packages, add-ons, and retainers). The specific scope, deliverables, and timeline for your project will be set out in a proposal, statement of work, or order form ("Project Agreement").

Scope and revisions

Deliverables and revision rounds are defined in your Project Agreement. Work outside the agreed scope (additional pages, features, or revision rounds) may be quoted separately. We will communicate clearly when a request falls outside scope.

Payment

Payment terms (e.g., deposit, milestones, or monthly billing for retainers) will be specified in your Project Agreement. Invoices are due as stated (e.g., net 14 or upon receipt). Late payments may incur interest or pause work until payment is received. Refunds are handled on a case-by-case basis and, unless otherwise agreed, are not provided once work has been substantially delivered.

Cancellation

Either party may cancel a retainer or ongoing engagement with written notice as specified in your Project Agreement (e.g., 30 days). For one-time projects, cancellation after work has begun may result in payment for work completed to date. Upon cancellation, we will provide any completed deliverables and materials you have paid for. We do not retain ownership of your content or brand assets.

Intellectual property

Upon full payment, you own the custom deliverables we create for your project (e.g., design files, code, and content we produce specifically for you). We retain ownership of our pre-existing tools, templates, and methodologies. Any third-party assets (e.g., stock imagery, fonts) remain subject to their respective licenses.

Client sites — "Built with SystemsUnity" credit

Unless otherwise agreed in writing, websites we build for clients may include a "Built with SystemsUnity" or "Website by SystemsUnity" credit in the footer, with an optional link to our website. This is part of our standard deliverable and supports brand awareness. If you prefer no credit, we can discuss alternatives (e.g., a one-time fee or different placement) before the project begins.

Limitation of liability

To the fullest extent permitted by law, our total liability for any claims arising from or related to our Services or this site shall not exceed the amount you have paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages. Some jurisdictions do not allow these limitations; where they apply, our liability will be limited to the maximum extent permitted.
